Conditions of service
These conditions are the agreement between your organisation and [LEGAL ENTITY NAME] (ABN [ABN]), "we" and "us", for the use of Cauchy.
1. The agreement
- These conditions, the acceptable use rules, the privacy policy and the survey data handling summary together make up the agreement. A separate signed agreement with your organisation, if there is one, takes precedence where it says something different.
- By using the service, you confirm that you may accept this agreement for your organisation. [LAWYER: acceptance mechanism]
2. Accounts
- The service is offered to organisations. There is no public sign-up: we set up your organisation's account and invite each person who will use it.
- Everyone signed in for your organisation can see its uploads, jobs and results. Your organisation is responsible for who it asks us to invite and for what they do with the service.
- Keep sign-in details private, and tell us if a person should no longer have access.
3. Your data
- Your survey data stays yours. You give us permission to store and process it only to run the jobs you submit, to review the results before release, and to support you.
- We keep your survey data confidential and do not reuse it, as described in how we handle your survey data.
- You confirm that you are entitled to upload the data and to have it processed this way.
4. What you receive
- For each line you submit, the service reports depths with their spread. Results are reviewed by us before they are released to you, and can be downloaded only after release.
- What a depth means: "The depth reported is the depth to a geophysical source -- a magnetic or density contrast -- below the measurement line. It is not a depth to ore. Where a body has been drilled, the source can sit away from it."
- Results are an input to your own interpretation and decisions. They are not advice to drill, buy, sell or invest, and you remain responsible for how you use them.
- Some lines cannot be processed (for example, a line too short for the depth asked for). The portal says so and gives the reason.
- Released results stay available for download for 7 days after release, then they are deleted. Download what you need to keep.
5. Protecting the service
Unless we have agreed otherwise in writing, your organisation and the people using the service for it must not:
- reverse engineer or decompile the service, or try to work out the method, models or settings behind it, from the service, its results or anything else we provide;
- use the service or its results to build, train, tune or benchmark a competing service, or any machine-learning or other AI model;
- submit synthetic, made-up or test data, by hand or automatically, to find out how the service behaves, except within a trial or evaluation we have agreed with you.
[LAWYER: draft clause; confirm its wording, how it sits with the acceptable use rules, and what follows a breach]
6. Commercial arrangements
Set out separately with your organisation.
7. Availability and changes
- We aim to keep the service available, but it may be interrupted for maintenance or by events outside our control. [LAWYER: service levels, if any]
- We may change the service. We will tell your organisation before a change that reduces what it receives for a job already submitted. [LAWYER: confirm]
8. Liability
[LAWYER: warranties, the Australian Consumer Law, limitation of liability, indemnity, and professional cover for reviewed results]
9. Ending the agreement
- Your organisation can stop using the service at any time and ask us to delete its data, as described in the privacy policy.
- We may suspend or close an account that breaks the acceptable use rules. [LAWYER: notice periods, termination for convenience]
10. Changes to these conditions
We will publish any change on this page with its date, and tell your organisation by e-mail before a change takes effect. [LAWYER: notice period]
11. Governing law
This agreement is governed by the law of [STATE OR TERRITORY], Australia. [LAWYER: jurisdiction]
